Bajaj Auto to sue TVS over patent infringement

Bajaj Auto, the country’s second largest motorcycle maker, is planning to sue rival TVS Motor Company (TVS) for infringement of intellectual property rights.

The charge is that TVS pinched Bajaj’s Digital Twin Spark Ignition (DTSi) technology for its new 125cc bike called the Flame. According to Bajaj, the
DTSi technology that it used for Pulsar and Discover models was registered in July 2002 under the patent number 195904. The forthcoming model Exceed is also expected to incorporate the technology.

Bajaj Auto’s DTSi technology uses two spark plugs at the two ends of the chamber. This enables faster combustion and efficient burning of the fuel-air
mixture. Result: more power and greater mileage. The company has said that the twin spark plugs were generally used by motorcycle engines with greater capacities. Bajaj Auto was the first to successfully use the DTSi technology in an engine with a small capacity. It added that the legal measures are currently being readied.

Adding that the patent violation by TVS related to terms of the purpose for which it was being used, the manner in which it was done, and the kind of customers who were being targeted, Bajaj plans to go ahead to safeguard its rights in the competitive two-wheeler scene. However, TVS maintains that it has not infringed on any company’s patent, adding that the TVS’ model Flame is being powered by an engine using CC-VTi technology.
